{"id":286,"date":"2016-09-07T11:58:52","date_gmt":"2016-09-07T10:58:52","guid":{"rendered":"http:\/\/voicenorthants.local\/myvoice\/?page_id=286"},"modified":"2016-11-23T17:17:14","modified_gmt":"2016-11-23T17:17:14","slug":"sentencing","status":"publish","type":"page","link":"https:\/\/www.voicenorthants.org\/myvoice\/the-court-process\/sentencing\/","title":{"rendered":"Sentencing"},"content":{"rendered":"<h2><strong>What sentence will the offender get?<\/strong><\/h2>\n<p>Magistrates and judges are responsible for deciding what sentence to impose on people found guilty of a crime. They have to take into account the following factors:<\/p>\n<ul>\n<li>The facts of the case<\/li>\n<li>Punishment<\/li>\n<li>Reducing crime<\/li>\n<li>Protecting the public<\/li>\n<li>Rehabilitating the offender<\/li>\n<li>Restorative justice \u2013 trying to repair the damage the crime has done to the victim and community<\/li>\n<li>Sentencing guidelines &#8211; these are guidelines set down by the Sentencing Council<\/li>\n<li>Circumstances of the offender &#8211; the Probation Service may need to produce a report about the offender.<\/li>\n<\/ul>\n<p>There are four types of sentence available to the courts, depending upon the seriousness of the crime. They are:<\/p>\n<h2><strong>Discharge<\/strong><\/h2>\n<p>This is when the court decides that given the character of the offender and the nature of the crime, punishment would not be appropriate. There are two types of discharge:<\/p>\n<p><strong>1) Absolute discharge<\/strong> &#8211; no further action is taken, since either the offence was very minor, or the court considers that the experience has been enough of a deterrent. The offender will receive a criminal record.<\/p>\n<p><strong>2) Conditional discharge<\/strong> &#8211; the offender is released and the offence registered on their criminal record. No further action is taken unless they commit a further offence within a time decided by the court (no more than three years).<\/p>\n<h2><strong>Fines<\/strong><\/h2>\n<p>The court can order that the offender pays a fine. The maximum fine allowed in a magistrates&#8217; court is \u00a35,000. Fines are unlimited in the Crown Court.<\/p>\n<h2><strong>Community sentences<\/strong><\/h2>\n<p>These combine punishment with activities designed to change offenders&#8217; behaviour and to make amends &#8211; sometimes directly to the victim of the crime. These can include:<\/p>\n<ul>\n<li>Compulsory (unpaid) work<\/li>\n<li>Participation in specified activities<\/li>\n<li>Programmes aimed at changing offending behaviour<\/li>\n<li>Prohibition from certain activities<\/li>\n<li>Curfew (may involve electronic tagging)<\/li>\n<li>Exclusion from certain areas<\/li>\n<li>Residence at a particular place<\/li>\n<li>Mental health treatment<\/li>\n<li>Drug treatment and testing<\/li>\n<li>Alcohol treatment<\/li>\n<li>Supervision<\/li>\n<li>Attendance at a particular place<\/li>\n<\/ul>\n<h2><strong>Imprisonment<\/strong><\/h2>\n<p>For the most serious offences the court may impose a prison sentence. The length of sentence is limited by the maximum penalty for that crime.
